“以案定员”模型决策分析

法官员额制是司法改革的重要部分,通过“以案定员”的方式可以解决“需要多少法官”这一突出性问题。通常法官员额的确定首先参考法院辖区经济社会发展状况、人口数量、案件数量等基础数据,再结合法院审计职能、法官工作量、人员配置、办案保障条件等因素。通过数据分析建模的方法测算法官员额,为法官员额的确定提供科学有效的计算方法,可以提高法官员额配置的有效性和准确性。

The quota of judgs is the key part of judicial reform.In order to improve the validity and accuracy of allocating judge quota,this paper measures the judge quota through modeling and analyzing the judicialdatato provide a scientific and effective way of calculating the number of judge allocation.This work solves the representative problem of“How many judges are needed?”by“Determine the number of judges through the case”.The number of judges should be calculated in terms of the fundamental data including the status of economic and social development,population and the number of cases in the destination area,combined with the workload of the judges,the staffingand the conditions for case handling.This paper analyzes the factors what impose impact on the number of cases and the handling of the cases.Based on this,the number of judges is calculated scientifically through information analysis and operational modeling.
