From Subject Theory to Human Dignity:A Logical Shift in Animal Welfare Legislation

西方以动物主体理论为基础的动物福利立法逻辑与我国的立法环境存在兼容性不高的现实困境。由于人类与动物的共生关系,动物福利与人格尊严密切相关。在宪法意义上,保障动物福利便是保护人的人格尊严。因此,从观照人格尊严的高度促进动物福利,可为动物福利立法提供新的路径参考。

The traditional animal welfare legislation based on the theory of animal subject has a realistic dilemma that it is not compatible with the legislative environment of our country.Due to the symbiotic relationship between humans and animals,animal welfare is closely related to human dignity.From the perspective of constitutional law,the protection of animal welfare is the protection of human dignity.Therefore,promoting animal welfare from the perspective of human dignity can provide a new path reference for animal welfare legislation.
