生态系统环境损害与生态破坏探析

Analysis of Ecosystem Environmental Damage and Ecological Destruction

2018年,我国开始实施生态破坏行为致农田生态系统损害鉴定,但是司法解释未明确司法鉴定过程中如何定义生态破坏行为、生态系统环境损害。因此,执业过程中遇到极大困扰,执业范围经常受到质疑。笔者以生态学理论为基础,根据多年从业经验,分析生态系统环境损害与生态破坏,以获得更多农田生态系统环境损害认知共识,促进该领域司法鉴定工作更加顺利地开展。

In 2018,China began to implement the identification of farmland ecosystem damage caused by ecological destruction,however,the judicial interpretation does not clarify how to define ecological destruction and ecological damage in the process of judicial identification.Therefore,great troubles have been encountered in the practice process,and the scope of practice is often questioned.Based on ecological theory and years of experience,the author analyzes the environmental damage and ecological damage of ecosystems,so as to obtain more consensus on the environmental damage of farmland ecosystems,and promote the smooth development of forensic identification in this field.
