利用优先权可以帮助医药领域的创新主体在长达1年的期限内做好向其他国家或地区提出专利申请的准备,从而对其专利实现更有效的保护。能否享受优先权的核心在于判断在后申请与首次申请是否属于相同主题,而医药领域发明相同主题的判断存在诸多特殊情况。本文择取其中部分情景予以阐释,指出技术效果是否相同是医药领域发明相同主题判断的关键因素之一,但相同技术效果无需完全相同的试验数据和结论;用药特征是否会导致主题不同,取决于是否会对制药过程造成实质影响;此外本文还对医药领域优先权核实中一些特殊情况予以阐释,希望通过本文对医药领域的创新主体合理利用优先权、开拓研发思路和进行专利布局提供一定的借鉴。

Utilizing patent priority can help the innovation subjects in the pharmaceutical field prepare sufficiently before submitting patent applications to different countries or regions within a period of up to one year,so as to achieve more effective protection on their patents.The key problem of whether or not granting the priority depends on judging whether the later application and the first application refer to the identical subject.There are many particular situations in the judgment of the identical subject in pharmaceutical field,thus this paper choose some of the scenarios to explain.Sharing the same technical effects is one of the key problems impacting whether the invention in pharmaceutical field refer to the identical subject,but the same technical effect does not need identical test data and conclusion,and whether the administration features will lead to different subject matter depends on its substantial impact on the pharmaceutical process,in addition,some other special cases about priority verification in pharmaceutical field are also introduced.It is hoped that this paper can provide some reference for the R&D ideas and patent layout of innovative subjects in pharmaceutical field.
