唯物史观视域中的权利正义问题研究

Study on the Rights Justice in the Context of Historical Materialism

马克思主义经典文本虽然甚少论及权利正义,但在马克思历史观的视域中权利正义却是事实与价值的统一。权利正义作为一个复合概念当然有抽象的方面,但是不能仅仅诉诸抽象化的理解。权利正义问题是具体的,有什么样的历史观就会产生什么样的权利正义观。无论是权利产生中的正义、权利分配中的正义、权利享有中的正义,还是权利保障中的正义,都是随着人类社会生产力的发展而不断变化、革新、运动着的。正确理解权利正义问题不仅有助于抵制西方自由主义法权思想的侵蚀、积极推动马克思主义中国化,而且有利于深化对社会主义市场经济的理解,维护良好的社会秩序,以及助力社会主义权利文化的构建。

Although the classic Marxist texts rarely talk about the justice of rights,in the perspective of Marx's historical view,the justice of rights is the unity of facts and values.As a compound concept,right justice certainly has an abstract aspect,but it cannot just appeal to an abstract understanding.The issue of right justice is specific,and what kind of historical view will determine what kind of right justice view will emerge.Whether it is justice in the generation of rights,justice in the distribution of rights,justice in the enjoyment of rights,or justice in the protection of rights,they are constantly changing,innovating and moving with the development of the productive forces of human society.A correct understanding of the issue of rights and justice will not only help resist the erosion of Western liberal ideas of legal rights and actively promote the Sinicization of Marxism;but also help deepen the understanding of the socialist market economy,maintain a good social order,and contribute to the socialist rights culture's build.
