《设备工程监理合同管理》教材的修订与完善

Revision and Improvement of Management of Contracts for Equipment Engineering Supervision

随着2020年《民法典》及其相关司法解释的颁布,2016版《设备工程监理合同管理》教材亟待修订,2021年7月,2021版教材正式出版。与2016版教材相比,2021版教材在结构上做了调整,相关章节的内容也依据最新法律法规做了完善和补充。为使读者有更好的阅读体验,本文从教材的修订背景及过程、修订的框架结构、修订涉及的主要内容以及修订留有的遗憾和未来展望4个方面对教材修订工作做了全面的说明。在第三部分修订的主要内容中,分别就第二章(民法的基本原则、自然人的行为能力、民事法律行为的效力样态、诉讼时效、专利权的主体)、第三章(合同示范文本、债的保全、债的担保、设备监理合同)和第五章(设备监理职业责任保险)的主要修订内容做了介绍。

With the promulgation of the Civil Code and related judicial interpretations in 2020,it is expected to make revisions to the 2016 edition of Management of Contracts for Equipment Engineering Supervision.In July 2021,the 2021 edition of the textbook was officially published.Compared with its predecessor,the new edition has a structural adjustment,with improvement and supplement to relevant chapters based on the latest laws and regulations.To optimize readers’ reading experience,this paper elaborates the revision from four aspects,namely,the background and process,the revision framework,the revision contents,as well as the defects and prospects.In Part 3,i.e.,the revision contents,this paper introduces the main revisions to Chapter 2(Basic Principles of Civil Law,Capacity of Natural Persons,Effectiveness of Civil Legal Acts,Statute of Limitations,Subjects of Patent Rights),Chapter 3(Model Text of Contract,Preservation of Debt,Guarantee of Debt,Equipment Supervision Contract) and Chapter 5(Professional Liability Insurance for Equipment Supervision).
