摘要
集体经营性建设用地入市中出现农地资源破坏、农村环境污染等环境问题,主要源于集体经营性建设用地入市中环境规制缺失、环境监管体制存在不足。在现实必要性上,集体经营性建设用地入市中环境问题的法律规制是维护农业生态安全的需要、促进集体经营性建设用地入市流转可持续推进的需要以及保障农民环境权益需要;在理论正当性上,环境正义理论为环境问题的法律规制提供理论支撑。基于此,应设计相应的理念、体制和机制贯穿环境问题规制的全过程,形成集体经营性建设用地入市中环境问题法律规制的基本进路;在制度架构方面,探索建立集体经营性建设用地入市的环境影响评估制度、环境风险预警制度、突发环境事件应急制度和环境损害修复制度。
The environmental problems such as destruction of agricultural land resources and environmental pollution in rural areas occurred in the process of collective productive construction land entering the market,are mainly related to the lack of environmental regulation systems and insufficient environmental supervision systems.In terms of practical necessity,the legal regulation of environmental issues in the process of collective productive construction land entering the market is the need to maintain agricultural ecological security,to promote the sustainable advancement of the transfer of collective operating construction land into the market,and to protect the environmental rights and interests of farmers;in terms of theoretical justification,the theory of environmental justice provides theoretical supports for the legal regulation of environmental problems.It is necessary to design corresponding concepts,systems and mechanisms throughout the entire process of environmental regulation,and form a basic approach for the legal regulation of environmental problems in the process of collective productive construction land entering the market;in terms of system structure,we should explore the establishment of the environmental impact assessment system,the environmental risk early warning system,the environmental emergency response system and the environmental damage rehabilitation system of collective productive construction land entering the market.
