调解前置程序适用的案件范围研究——基于B市基层法院改革试点的调查分析

Application of the Pre-Mediation Procedure——B City’s Pilot Reform as an Example

根据调解前置程序的功能定位,调解前置程序适用的案件可分为分流型纠纷和促进型纠纷两类。通过对B市4家基层法院调解前置程序改革试点中不同类型案件适用调解前置程序成熟度的分析,界定分流型纠纷中适宜的案件范围。以案件当事人的特殊关系为基础依据,从妥善化解纠纷,促进社会和谐的角度分析促进型纠纷适用调解前置程序的适宜性。

As of its the functional orientation, the pre-mediation procedure cases can be divided into two categories:facilitative disputes and distributive disputes. This paper analyzed the application scope of the two disputes separately on the basis of cases maturity in four grassroots courts of B City, and defined their special relationship. It found that the facilitative disputes more focused on resolving cases from the perspective of promoting social harmony.
