实用新型专利审查质量提升研究

摘要 目前的实用新型专利审查工作,存在着从申请人的角度出发法条裁判标准不统一、审查员心证自由度较大、审查思路难以追溯还原、审查质量控制难度大等问题。通过对审查实践中存在的问题的来源、表现进行分析,找到实用新型专利实质性法条的审查过程为突破口,以规范审查意见和审查思路为作为研究的核心目标,从设计模型化手段建立“事实模型”“法律模型”“映射模型”规范审查意见的构建开始,将“事实认定准确、法律适用正确、审查意见明确”的要求拆分为可以操作的,各自独立并相互影响的三个模型,分别建立了三个模型的要件化构成标准,形成了构建审查意见的标准化的、可以操作并相对易于理解的方法思路。在此基础上,研究设计了配套的模型化评价机制、辅助机制,从而在整体上得到了一个适合实用新型专利审查实践中审查质量提升的体系。 Currently,utility model examination work facing problems on standardizing.These problems are reflected as following appearance in practice:inconsistent legal judging standards from the perspective of the applicant,the examiners'over-freedom in evaluation,the difficulty in retrospective review and examination quality control.By analyzing the sources and manifestations of the problems existing in the review practice,we found a standardized process for examination of utility models as a breakthrough.Regarding the standard review opinions and review ideas as the core objectives of the research,we established the"model"method by splitting the examination work into 3 independent but mutually influencing parts as"factual model","legal model"and"applying model",which reflecting to the requirements of"accurate fact determination,correct application of law,and clear review opinions".And we have established criteria for these 3 models,to form a standardized,operable and relatively easyto-understand method of constructing examination opinions.On this basis,we designed an evaluation mechanism and auxiliary mechanism as supporting so as to obtain a system suitable for improving the examination quality of utility model examining works.
