摘要
合规不起诉制度建设已经成为当前刑事合规试点改革的重点内容。但对于这项制度应如何建立,尚处于初步探索阶段。当前,涉罪企业合规不起诉制度在适用范围、不起诉方式的选择、合规有效性标准评价、第三方合规监管、检察机关不起诉权规范等方面仍面临诸多争议。未来立法可以建立企业合规不起诉制度体系,并着重从程序供给与权力规范两个层面,以合理设定适用对象的范围、建立层次性的合规有效性标准、建立常态化的监督回访机制、强化检察机关主导地位、设置不起诉裁量标准与建立检察权运行的监督制约机制等具体方式,进一步完善合规不起诉制度的整体建构。
Constructing corporate compliance non-prosecution system has become the focus of current pilot reform on the criminal compliance. However, establishing the system is still in the preliminary exploration stage.At present, there are disputes about compliance non-prosecution system of suspected enterprises, including the application scope, non-prosecution method choice, compliance effectiveness criteria evaluation, compliance supervision of the third parties and standardization of the procuratorial organ’s power. A non-prosecution system can be established on corporation compliance from procedure supply and power regulation. Further overall improvements of compliance non-prosecution system can be made by setting the scope of applicable objects, establishing effective hierarchical compliance standards, building a regular monitoring and return visit mechanism, strengthening the leading position of the procuratorial organ, positioning non-prosecution discretion standards and fixing supervision and restriction mechanism for procuratorial power operation.
