实践中,由自伤行为所导致的疾病状态已成为部分惯犯行为结构的固定要素。行为是主体在认知结构的指导下,以在信息环境中明确行为需求为基础做出的认知理性下的“最优选择”。通过手段目的链模型构建的认知结构图式,可以反映出惯犯在犯罪情境下基于自我满足的终极追求。解决涉及自伤惯犯的执法困境,直接要求是消除对自伤惯犯消极的执法惯性,制度保障是参照强制隔离戒毒规定建立强制治疗制度,治理根本是疏通郁结的社会需求和上升通道。

In practice,the disease state caused by NSSI has become a fixed element in the behavior structure of some repeat offenders.As a dynamic coding knowledge system with constructive meaning,cognitive structure can help individuals to clarify information needs in the information environment in the most effective way and make the“optimal choice”under cognitive rationality.The cognitive structure of repeat offenders of NSSI is the knowledge system about NSSI behavior and scene which is formed by repeat offenders in the form of code in the specific criminal environment.The cognitive structure schema constructed by means-end chain model can reflect the ultimate pursuit of self-satisfaction of recidivism in criminal situation.To solve the law enforcement dilemma involving repeat offenders of NSSI,it is required to eliminate law enforcement inertia of repeat offenders of NSSI,to shorten the procedural interval of enforcement power and decision-making power of suspects of NSSI,and to clear up the social demand and rising channel.
