论大学治理中的释法说理功能

The explanation and reasoning function of university governance

全面依法治国战略要求大学治理法治化不断发展和彰显,在建章立制的基础上,依法治校需要方法,特别是解释学的推动从而更加立体和鲜活。依法治校的“法”包含国家法律和校内规范两类,通过对两类“法”的解释助推依法治校。解释实践在依法治校过程中主要通过文义解释、体系解释、目的解释和其他解释方式得以展现,使各类法治资源得到实质性的应用,让静态的“法”和大学治理充分衔接,服务依法治校。

The comprehensive strategy of rule of law requires the continuous development and demonstration of the rule of law in university governance.On the basis of the establishment of rules and regulations,govening university allording to law needs methods,especially the promotion of hermeneutics,so as to be more three-dimensional and vivid.The“law”of running a school according to law includes national laws and school norms.The interpretation of the two kinds of“laws”helps to run a school according to law.In the process of running a university according to law,the practice of interpretation is mainly demonstrated through literal interpretation,system interpretation,purpose interpretation and other interpretation methods,so that all kinds of legal resources can be applied substantively,and the static“law”can be fully connected with university governance to serve the management of a university according to law.
