社会合作规制与新行政法的建构--从疫情群防群控切入

Social Co-Regulation and the Construction of New Administrative Law:From the Perspective of COVID-19 Epidemic Prevention and Control by the Masses

新冠肺炎疫情的群防群控实践折射出复杂的行政法治新课题。作为以社会为重心的新合作规制模式,社会合作规制经受了本土突发事件防控的检验,并形成了自身运行特色。社会合作规制具有促进传统规制模式的升级、实现风险社会的合作治理以及推动法治社会的共建共治共享等诸多功能优势。社会合作规制的兴起,对于传统公私对抗的法理念以及基于此理念而构建的行政主体、行政行为以及行政救济等知识体系构成结构性的挑战,亟待建构一种新行政法。从路径选择上看,发展公私合作的新行政法治理念,按照以社会为中心的合作治理精神,对公私合作行政法的主体论、行为论和救济论等模式构造进行系统建构,成为优化新行政法结构的主要使命。

The practice of COVID-19 epidemic prevention and control by the masses reflects a new complex topic about administrative rule of law.As a new model of cooperative regulation focused on the society,social co-regulation survives the test of prevention and control of local emergencies,and forms its own operational characteristics.It has many functional advantages.Its emergence has posed a structural challenge to the traditional legal concept of public-private confrontation and the knowledge system on administrative subjects,administrative behaviors and administrative relief based on such concept,thus calling for the construction of a new administrative law.From the perspective of path selection,the main mission of optimizing the structure of the new administrative law is to develop the new concept of administrative rule of law of public-private cooperation,and systematically construct the subject theory,behavior theory and relief theory of the administrative law of public-private cooperation in accordance with the spirit of social-centered co-governance.
