中国共产党领导律师职业建设的政策立场及其演进逻辑——基于《人民日报》报道的实证考察

On the CPC’s Policy Orientation and Evolutionary Logic in Leading the Construction of Lawyers’ Profession——Based on the Empirical Review of Reports in People’s Daily

对于律师这个"舶来品",中国共产党在不同时期的态度和政策是有差异的。通过研究《人民日报》相关报道的整体特征和传播倾向,可以略窥党在律师职业建构中的政策取向和原则立场。从历史发展的视角来看,党对律师在代表国家治理现代化方面所具有的标志性意义有清晰的认识,对律师职业的建构和发展有整体的规划。党在律师职业建构中所采取的政策立场和结构性调整,一般是有其公共考量在内的。党在不同时期对律师的功能定位和角色期待,决定了这个职业在《人民日报》的报道中呈现出了明显的角色变迁和多元面相。

As for lawyers originated abroad, the CPC’s attitude and policies varied in different periods. By studying the overall characteristics and dissemination tendency of relevant reports in People’s Daily, we could have a glimpse of the policy orientation, principle and standpoint of the CPC in the construction of the lawyers’ profession. From the perspective of historical development, it could be found that the CPC has a clear understanding of the symbolic significance of lawyers in representing the modernization of national governance, and has an overall plan for the construction and development of the lawyers’ profession. The policy standpoints and structural adjustments adopted by the CPC in the construction of lawyers’ profession are generally related to its public considerations. The functional positioning and role expectations of lawyers by the CPC in different periods determine that lawyers have been shown obvious role changes and multiple facets in the reports of the People’s Daily.
