毒品灭失犯罪案件证据认定的疑难问题研究

An Analysis of Evidence Identification in the Case of Drug Loss

毒品的易毁损性、犯罪行为的间接性和证据的单一性等特点,以及侦查机关在侦查取证过程中的不规范、不全面给毒品灭失案件的证据审查认定造成极大障碍。在毒品犯罪案件中,毒品的数量是证据链条中最关键的证据,不仅体现了犯罪行为的社会危害性大小,更决定了罪名的认定以及量刑的幅度。从检察机关审查起诉角度对毒品灭失情况下毒品数量的认定难题进行具体分析,有助于在司法实践中侦查机关更加科学合理全面地收集证据,以及检察机关正确审查认定案件证据。

Drugs are easy to be destroyed,the criminal acts related to drugs are usually indirect and the relevant evidence features in singleness–these characteristics,together with the unstandardized and incomprehensive practices of investigation organs in the process of investigation and evidence collection,have brought about great obstacles for the evidence identification in the case of drug loss.In drug crime cases,the quantity of drugs is the most critical evidence in the evidence chain,which not only reflects the social harmfulness of criminal acts,but also determines the identification of charges and the range of sentencing.From the perspective of inspection and prosecution of supervisory organs,this paper analyzes the problem of drug quantity identification in the case of drug loss,and puts forward reasonable methods,so as to provide helpful suggestions for the investigation organs to collect evidence more scientifically and comprehensively and for the prosecutorial organization to examine and confirm the evidence of the case correctly.
