《行政处罚法》修订背景下卫生健康执法问题及对策

Problems and countermeasures of health law enforcement under the background of the revised Administrative Punishment Law

2021年《行政处罚法》进行了第三次修改,在概念种类、设定权限、主体、程序、执行等制度方面进行了完善,体现了近年来我国行政执法实践的进步。同时,面对即将实施的新要求,卫生健康领域执法工作存在亟需完善的问题,需要加强执法队伍建设,探索建立新的执法模式,推动执法重心的下移,重视法制审核,加强司法协助,完善行政处罚的相关制度等。

The Administrative Punishment Law of the 2021 has been amended for the third time,and the revised Administrative Punishment Law has been improved in terms of concept type,setting authority,subject,procedure,execution,etc.,it reflects the progress of China’s administrative law enforcement practice in recent years.At the same time,in the face of the new requirements to be implemented soon,there are problems in the law enforcement work in the field of health that need to be urgently improved.It is necessary to strengthen the construction of law enforcement teams,explore the establishment of new law enforcement models,promote the downward shift of law enforcement focus,and attach importance to the examination and verification of the legal system,strengthen the assistance with the judiciary,improve the relevant system of administrative punishment.
