法治作为治国理政的基本方式决定了法治是解决公共体育服务领域问题的有效方式。随着现代化的发展,法治也需要与时俱进,政府购买公共体育服务作为新兴领域需要加强立法,制定行之有效的专门性法律法规。为此,针对政府购买公共体育服务购买内容、购买主体、承接主体及合同治理面临的法治困境进行分析。建议从法律层面明确政府购买公共体育服务范围及标准,完善购买目录、规范购买程序、明确社会组织法律地位并加强合同签订与实施过程的监督力度,避免政府购买公共体育服务的潜在风险。

The rule of law as a fundamental way of governing the country determines that it is an effective way of solving problems in the field of public sports services. With the development of modernization, the rule of law also needs to keep pace with the times, and the government’s purchase of public sports services as an emerging field needs to strengthen legislation and formulate effective and specialized laws and regulations. To this end, an analysis is made of the rule of law dilemmas facing the government’s purchase of public sports services in terms of purchase content, purchasing subjects, undertaking subjects and contract governance. It is recommended that the scope and standards of government purchase of public sports services be clarified at the legal level, the purchase catalogue be improved, the purchase procedures be regulated, the legal status of social organisations be clarified and the supervision of the contract signing and implementation process be strengthened to avoid potential risks in government purchase of public sports services.
