网络环境下隐私权保护的法理探究

网络中的隐私权不同于传统概念上的隐私权,网络环境中隐私权的保护时常存在不同权益之间的冲突问题,因此通过有效途径解决好各种冲突成为隐私权保护的关键。文章首先研究隐私权与言论自由权和商业发展等利益之间的冲突,其次探究为化解此类冲突所应当遵循的基本原则,最后提出网络环境下隐私权的保护路径,以利于合理保护隐私权的同时又不妨碍网络给社会带来的进步,同时也为以后法律的完善提供明确方向。

The right of privacy in the network is different from the right of privacy in the traditional concept. The protection of the right of privacy in the network is often conflicted between different rights and intereststs. Therefore, solving various conflicts through special channels has become the key to privacy protection. First, study the conflicts between it and the rights of freedom of speech and commercial development, second, explore the basic principles that should be followed to resolve such conflicts, and finally propose a perfect path for privacy rights in the network environment to facilitate the reasonable protection of privacy rights without hindering the progress that the internet brings to the society, and also provides a clear direction for the improvement of the law in the future.
