摘要
留用地制度作为一种地方政府探索实践的征地补偿补充措施,过去在推进征地工作和城镇化进程中发挥了重要作用。然而随着时间的推移,留用地制度逐渐暴露出一些缺陷,不仅未能有效发挥留用地社会保障功能,甚至还衍生出一系列问题阻碍城市建设与经济发展。以往相关文献对留用地多为“回应问题”型的对策研究,缺乏对留用地本质及问题根源的探索。基于此,文章系统分析了我国留用地制度的演进历程、特征及执行困境,并引入土地发展权的概念对留用地本质、问题发生机理进行分析,并从保障和提升开发权益、打造可持续发展模式两方面出发,提出我国留用地制度的优化方向。
Rural reserved land has played an important role in land acquisition and urbanization as a local practice of compensation for land acquisition.Over time some problems of regulation for reserved landhave emerged,which not only cannot perform the social security function of rural reserved land effectively,and even impede urban and economic development.Current researches mostly deal with the solution of the problems and rarely explore the essence and origin of the problems.The paper studies the evolution,characters,and practical dilemmas of rural reserved land,introduces the concept of land development right to analyse the nature and problem mechanism of reserved land,and puts forwards improvement suggestions from two aspects:ensuring development right,and building a sustainable development mode.
