基层治理视角下的知识产权行政保护能力研究——以机构改革后湖北省W市13个区的市场监管局为样本

A Study of the Capacity for the Administrative Protection of Intellectual Property from the Perspective of Grassroots Governance:A Case Investigation into Administrations for Market Regulation of 13 Districts in W City of Hubei Province After Institutional Reform

通过基层治理视角审视知识产权行政保护能力,对推进知识产权领域治理现代化具有重要价值。以新一轮机构改革之后湖北省W市13个区市场监管局实施知识产权行政保护为样本,调研后发现,基层知识产权行政保护面临行政执法“弱化”和行政管理与服务“不足”的新挑战。提升基层知识产权行政保护能力需要以作为一种理念的“知识产权国家治理体系”为指导,确立以多主体参与、多环节协调为核心要义的治理理念;并通过制度创设来实现:规定知识产权行政执法技术调查官制度,并创新落实上级行政机关的指导协调职责,还需要为基层市场监管局明确界分与强化行政奖励、行政合同、行政指导、行政资助和行政预警等行政方式来提升基层知识产权行政管理和服务能力。

It is of great value for the modernization of governance in the field of intellectual property to examine the capacity for the administrative protection of intellectual property from the perspective of grassroots governance. It is found from a case investigation into the administrative protection of intellectual property implemented by administrations for market regulation of 13 districts in W City of Hubei Province after a new round of institutional reform that the administrative protection of intellectual property at the grassroots level is facing new challenges from the“weakened”administrative law enforcement and the“insufficient”administration and services. To improve the capacity for the administrative protection of intellectual property at the grassroots level should be guided by the“national governance system of intellectual property”,should be based on the governance concept in which multi-agent participation and multi-link coordination are taken as the core principle,and should be realized through the innovation of administrative law system:The technical investigator system for the administrative law enforcement of intellectual property should be stipulated;The guidance and coordination responsibilities for superior administrative organs should be innovated and implemented;It is also necessary for grassroots administrations for market regulation to make clear demarcations and strengthen administrative means such as administrative reward,administrative contract,administrative guidance,administrative financial support,and administrative early warning to improve the grassroots capacity for intellectual property administration and services.
