近年来,随着互联网的不断发展,数字技术利用其精确而复杂的算法来优化公民的生活,改善人们的生活方式。然而,基于个体差异,人们在获取、理解和应用数据方面存在优缺点,“数字弱势群体”一词也在这种情况下诞生。通过厘清数字鸿沟的本质,剖析数字弱势群体的多维成因,发现数字技术的内在特征、权利类型尚未明确和网络空间秩序的失衡是数字弱势群体的根本原因,通过完善的法律解释、倾向案例判断,进一步强调数字人权的概念,保护社会数字弱势群体的基本权利。

In recent years, with the continuous development of the Internet, digital technology uses its precise and sophisticated algorithms to optimize the lives of its citizens and improve people’s lifestyle.However, based on individual differences, people have advantages and disadvantages in obtaining, understanding, and applying data, and the term "digital disadvantaged" was born in this context.By clarifying the nature of the digital divide,analyzing the multidimensional causes of digital vulnerable groups, found that the internal characteristics of digital technology, rights type has not been clear and the imbalance of the cyberspace order is the fundamental cause of digital vulnerable groups, through the perfect legal interpretation, tendency case judgment, further emphasize the concept of digital human rights, is expected to protect the basic rights of social digital vulnerable groups.
