深层链接指的是直接指向被链网站次级网页的链接,深层链接的发展一方面代表了飞速进步的信息技术,另一方面也增加了信息网络传播权侵权认定的难度,使相关权利人的合法权益无法得到保障。聚合平台提供深层链接行为的法律定性是当前信息技术发展程度下亟待解决的难题,学界对其法律性质的认定标准主要有三种学说的争议,结合国际条约、国内法律、法院判决说明不同学说将如何认定聚合平台提供深层链接行为的法律性质,权衡利弊后确定应继续坚持服务器标准。通过明确举证证明责任的分配、依据技术措施法律规范进行规制、反不正当竞争法兜底等各种配套措施重塑服务器标准,可更好平衡不断变化发展的各方利益。

Deep links refer to links that directly point to secondary web pages of the chained website.The development of deep links represents the rapid progress of information technology on the one hand,but on the other hand, it also increases the difficulty of determining the infringement of information network dissemination rights, so that the legitimate rights and interests of the relevant right holders cannot be protected. The legal characterization of providing deep links on aggregation platforms is a difficult problem to be solved under the current degree of development of information technology, and there are mainly three controversial doctrines in the academic community regarding the criteria for determining its legal nature. The standard should be reshaped through various complementary measures,including the allocation of the burden of proof, regulation based on the legal regulation of technical measures, and underwriting by the anti-unfair competition law, in order to better balance the interests of all parties in the ever-changing development.
