《长江保护法》的出台是立法层面贯彻和落实“最严”生态法治观的体现,为保护长江流域生态环境提供了全面的法律依据。要实现长江流域生态环境的“最严”保护,还需要刑法提供相应的保障。《刑法》与《长江保护法》的对接应坚持“最严”生态法治观,在范围上实现对长江流域生态环境的全方位保护。在设定对接标准时,应强化其明确性并注重不同刑法条文之间的协调性;同时还应坚守“最严”的取向,全面及时地为司法实践提供依据。

The adoption of the"Yangtze River Protection Law"highlights the implementation of the"severest"legal concepts of ecological environment at the legislative level,which provides a comprehensive legislative authority for protecting the ecological environment of the Yangtze River Basin.In order to achieve the"severest"protection of the ecological environment of the Yangtze River Basin,the criminal law is needed to provide corresponding protections.The connection of the"Criminal Law"and the"Yangtze River Protection Law"should be maintained to focus on the"severest"legal concepts of ecological environment and realizing all-round protection of the ecological environment of the Yangtze River Basin.When setting the standard of connection,the clarity of the standard should be emphasized for the coordination between different provisions of the Criminal Law,so as to provide comprehensive and timely legal basis for consistent judicial practice with the"severest"orientation.
