摘要
分析同人作品与原作品、同人作者与原作者之间的利益冲突。对美国合理使用四要素的适用进行研究,以《哈利·波特》类同人作品为例,探索同人作品合理使用路径,保护各方权益。
The conflicts of interests between the fanficiton works and the original works,and between the fanfiction authors and the original authors are analyzed.This thesis makes a study of the application of rational use of the four elements in fanfictions in the United States,and takes the case of the fanfiction Harry Potter as an example to explore the path of rational use of fanficitions and protect the rights and interests of all parties.
