摘要
在三孩政策的背景下,部分学者提出延长女性产假以保障其权益。然而,延长产假的本质是将女性囿于家庭中,反而会造成女性在职场中的隐形歧视。强调女性职责的单系抚养理念不符合时代发展趋势,完善家庭生育假制度必须秉持双系抚养的理念,男性与女性都需要承担家庭职责。双系抚养有利于发挥父亲角色的作用,促进家庭和睦,并在一定程度上改善女性在职场中受歧视的状况。家庭生育假的构建应当以产假与育儿假为核心内容、以建立法律规范体系为主线、以完善配套措施为抓手。
In the context of the three-child policy,some scholars have proposed to extend maternity leave for women to protect their rights.However,the nature of extending maternity leave is to confine women to the family,but it will cause invisible discrimination against women in the workplace.The single parenting concept that emphasizes women’s responsibilities is not in line with the development trend of the times.To perfect the family maternity leave system,the dual parenting concept must be adopted.Men and women both need to assume family responsibilities.Dual parenting is conducive to playing the role of father,promoting family harmony,and to a certain extent,reducing discrimination in the workplace.The construction of family maternity leave should take maternity leave and parental leave as the core content to establish a legal system and improve supporting measures.
