Re-analysis on System Problems of Administrative License

行政许可已经成为我国政府进行社会治理的重要手段,对于维护社会经济秩序的稳定发挥了重要作用。从“以人民为中心”的治理理念出发进行检视,《行政许可法》内含“权力思维”的立法逻辑,且仍然存在设定权限不明、范围过宽、监督机制不健全等行政许可设定问题,以及自由裁量权大量存在、实施程序不完备、实施主体利用行政许可权利滥收费用、地方保护政策的干扰等行政许可实施问题。应当充分结合实际,贯彻法治政府、责任政府、服务政府理念,从行政许可的设定和实施两大方面进行完善,促进我国行政许可制度健康发展。

Administrative licensing has become an important governance method for the Chinese government to conduct social management,and has played an important role in maintaining the stability of the social and economic order.Starting from the"people-centered"governance idea,the"Administrative Licensing Law"still has the legislative logic of"power thinking".Moreover,there are still problems in the setting of administrative licenses,such as unclear authority,over-wide scope,and incomplete supervision mechanism,as well as the existence of a large number of discretionary powers,incomplete implementation procedures,the implementation of administrative license rights to overcharge,and local protection policies.Interference and other administrative licensing implementation issues.It is necessary to fully integrate the reality,implement the concept of a government by law,a responsible government,and a service government,and improve the establishment and implementation of administrative licenses to promote the healthy development of China's administrative license system.
