对当前我国统一法律适用的完善思考

《最高人民法院关于完善统一法律适用标准工作机制的意见》确立了统一法律适用标准就是为了类案同判,并且为我国司法系统关于推进统一法律适用标准提供了指引。在此情况下,应当考虑的是统一法律适用,也就是要实现“类案同判”,我们的工作不止于此,仍需要进一步的发展和细化。应当明确和统一“类案同判”的内涵,即要分析识别“类案”的三个具体要素,明确“同判”在效果层面的表现。同时要发挥裁判要素统一对统一法律适用的积极作用,做到司法理念的统一、证据认定标准的统一以及法律适用和解释的统一。另外,还应发掘当事人在统一法律适用中的潜力,积极对其提交法律适用意见书提供规范指引。
