完善公安行政证明制度初探

On Perfecting the System of Public Security Administrative Certification

公安行政证明行为是公安机关社会治安管理活动的重要内容。当前公安行政证明制度面临着实践与学理的双重困境:在实践操作中,公安行政证明与每一位人民群众切身利益息息相关,各种不切合实际、缺少必要性的"奇葩证明"饱受社会舆论关注甚至苛责;与极高的社会关注度形成鲜明对比的是,在学术理论上,该制度的研究寥寥,理论尚未能有效指导实践。构建一套契合当下行政程序规范与公民诉求的公安行政证明制度体系,积极探索大数据与服务型政府构建背景下,行政证明行为的"毋需证明"与"不证自明"模式,对于深化公安机关放管服改革具有着重要意义。

Public security administrative certification is an important element of the social security management activities of public security organs.At present,the system of public security administrative certificates is faced with both practical and academic dilemmas:in practice,public security administrative certificates are closely related to the vital interests of every citizen,and various unrealistic and unnecessary"odd certificates"are subject to the attention and even censure of public opinion;in contrast to the high level of social concern,there has been little research on the system in academic theory,and theory has not yet been able to effectively guide practice.Therefore,there is little research on this system in academic theory,and theory has yet to effectively guide practice.It is of great significance to deepen the reform of the public security organs.
