摘要
在共享经济的背景下,我国长租公寓发展迅速,以高进低出和长收短入的方式迅速占领市场。但同时带来了极大的法律风险,主要包括主体间的合同风险和运营过程中的客观法律风险。长租公寓“暴雷”造成了恶劣的社会影响,成了影响民生的社会问题。降低长租公寓的法律风险需要引起重视,可从完善规范长租公寓运营的法律法规和健全政府为主导的长租公寓监管体系以及建立社会服务行业信息共享渠道三方面入手。
In advent of sharing economy,long-term rental apartments have developed rapidly in China,which occupy the market shortly by buying in high price but selling in lower price.However,at the same time,it also brings great legal risks,which include contract risks between subjects and objective legal risks in operation process.If these risks can’t be controlled in time,"thunder storm"of long-term rental apartments is inevitable,which has become social problems affecting people’s livelihood.Therefore,effectively reducing the legal risks of long-term rental apartments should be attached great attention to.We can start from three aspects:perfecting the laws and regulations that regulate the operation of long-term rental apartments,improving the government-led long-term rental apartment supervision system and establishing information sharing channels in social service industries.
