民法是符合市民社会的人法,民法精神是人类规范自身信仰和社会秩序的标准,这一切最终源于道德和道德精神,没有道德的民法和民法精神是空洞和无序的。民法精神是一种社会规范精神,是体现民法制度形式的人性精神,这种人性精神不仅可以通过行为和规范体现,而且应当接受社会道德和道德精神的考验和指导。从这一观点来看,民法精神的自律性秩序规范的建构基础应当以道德和道德精神为内在基础。作为民法上的内在行为价值规范,民法精神需要通过道德和道德精神的指引和修缮来维护我国民法体系的逻辑构建,这不仅是人类生存之本源,也是社会经济发展之基础,并能够为民法精神的自律构序提供伦理基础和理论条件。

Civil law is a human law in line with civil society, the spirit of which is the standard for human beings to regulate their own beliefs and social order. All of this ultimately comes from morality and moral spirit, without which civil law and civil law spirit are empty and disorderly.
