矿业权人信息公示制度实施情况与完善建议

Implementation and Improvement Suggestions of Information Publicity System for Mining Right Holders

矿业权人勘查开采信息公示作为矿产资源勘查开采监督管理改革的一项重要举措,自实施以来在规范矿业权人勘查开采行为、督促其履行法定义务、建立矿业领域诚信体系中发挥了重要作用。文章在系统梳理矿业权人信息公示制度实施效果和存在的问题基础上,结合当前诚信体系建设的新要求和矿产资源法修改的精神,提出了以问题为导向完善信息公示办法的对策建议:(1)修改完善公示办法,以部门规章形式发布实施;(2)将信息公示制度纳入矿产资源法;(3)建立信息公示制度体系,完善相关配套制度和标准规范;(4)完善公示系统功能。

As an important measure of the reform of mineral resources exploration and mining supervision and management,the publicity of exploration and mining information of mining right holders has played an important role in the following aspects,including regulating the exploration and mining behavior of mining right holders,supervising them to fulfill their legal obligations and establishing a credit system in the mining sector.On the basis of systematically reviewing the implementation effect and existing problems of the information publicity system of mining right holders,combined with the new requirements of the current credit system construction and the spirit of the amendment of the Mineral Resources Law,this article puts forward the following countermeasures and suggestions to improve the information publicity methods based on the problem:(1)revise and improve the publicity measures,and publish and implement them in the form of departmental regulations;(2)incorporate the information publicity system into the Mineral Resources Law;(3)establish the information publicity system and improve related supporting systems and standards;(4)improve the function of publicity system.
