做好中国环境法典编纂的时代答卷

彰显时代特色是法典编纂的历史使命。编纂一部满足"建设人与自然和谐共生的现代化"需求的环境法典,是中国环境法典编纂研究必须交出的时代答卷。如何满足人民群众对美好生活环境的向往这个新时代终极追求之问,是环境法典编纂研究回应新时代生态文明法治的根本立场;如何处理好安全与发展的关系这个人与自然关系重构之问,是环境法典编纂研究回应新时代生态文明法治需求的方法论;如何提升环境治理体系现代化水平及能力这个重构环境治理体系之问,是环境法典编纂研究回应新时代生态文明法治需求的制度路径;如何共建地球生命共同体这个环境法典的民族性与国际性之问,是环境法典编纂研究回应新时代生态文明法治需求所追求的共谋人类命运共同体的最佳效果。中国环境法典编纂研究需要从立场、方法、路径和效果四个方面,提供体系化方案,保障"美丽中国"目标实现。

Showing the characteristics of the times is the historical mission of codification. The codification of an environmental code to meet the needs of "building a modernized system for the harmonious co-existence of human and nature" is the answer of the times that China’s environmental codification research must deliver. How to meet the people’s aspiration for a better living environment, the ultimate pursuit of the new era, is the fundamental position of the environmental codification study in response to the new era of ecological civilization rule of law. The question of how to deal with the relationship between security and development, a question of reconstructing the relationship between human beings and nature, is the methodology of the study to respond to the needs of the rule of law of ecological civilization in the new era. The question of how to enhance the level of modernization of environmental governance system and its ability to reconstruct the environmental governance system is the system path for the codification study to respond to the needs of the rule of law of ecological civilization in the new era. The question of how to build a community of life on earth, a national and international question of the environmental code, is the best result of the codification study to respond to the building of a community with a shared future for mankind which is pursued by the rule of law of ecological civilization. The research on the environmental codification of China needs to provide systematic solutions in four aspects: position, method, path and effect, to ensure the realization of the goal of "beautiful China".
