环境法典污染控制编的行政法律责任

On the Administrative Legal Responsibility in the Pollution Control Chapter of Environmental Code

Legal responsibility is an important content in the current pollution control laws. How to set rules of legal responsibility in the pollution control chapter of the environmental code needs to be carefully considered. According to the regular pattern of the codification of the code and the basic logic of the pollution control system, the system value and the existing problems can be found by analyzing and sorting out the responsibility rules in the current pollution control laws. Furthermore, based on the types and nature of pollution violation, the administrative responsibility of pollution control should mainly be administrative sanctions and administrative penalties. Meanwhile, the existing responsibility rules should be integrated and optimized, and they should be separately stipulated in the pollution control chapter and ecological environment responsibilities chapter based on the differences in commonality and pertinence. The pollution control chapter shall include rules of administrative legal liability for specific pollution violation, in which property punishment and behavioral punishment should be reasonably designed in accordance with the forms of violations. Besides, new forms of administrative penalties should be created to guarantee the effective implementation of the pollution control system.
