摘要
公共资源民间参与经营在20世纪80年代以后已成为一种持续全球化的现象。我国推行市场经济以来,尤其随着政府职能的转变,公共资源的经营有了一个新的趋向,那就是由民间组织或者私人参与经营。这就带来了一系列需要厘清的法律问题,如哪些公共资源可以民间参与经营、民间参与经营以后主体的法关系如何定位、民间参与经营以后行政法治如何应对等。公共资源民间参与经营应当放置在行政法治的大视野中进行认知和考察:公共资源要实现民间参与经营,其主体的行为只有在符合相应客观要件的前提下才能够成立;应当针对公共资源民间参与经营专门制定一个带有总则性的行政法典则,并在这个总则性的典则中确立相应的原则;在今后的法律建构中控制公共资源民间参与经营的公权滥用应当作为一个重点问题予以处理;公共资源的发包者应当在一定范围内随经营者的行为负法律责任或连带责任。
Privatization of public resources has become a continuous globalizing phenomenon since the 1980 s, Since our country implements market economy, the operation of public resources has a new trend that public resources are operated by private organizations or individuals. This leads to a series of legal issues to be clarified, such as which public resources can be privatized, how to position legal relations of entities after privatization, how to deal with administrative rule of law after privatization, etc. This paper suggests that privatization of public resources should be positioned in the whole view of administrative law. The implementation of privatization of public resources depends on the premise that the acts of entities meet objective requirements. it is necessary to enact a united administrative code on privatization of public resources and make related principles in the united administrative code;controlling the abusement of public authority should be treated as an important issue to be resolved in legal construction in the future;contractors of public resources should bear legal liability or joint liability based on operators’ acts within a certain range.
