失信联合惩戒制度产生的缘由包括建设诚信社会以及弥补事后监管的缺陷。但该制度在立法以及实践中出现的泛化问题日益显著,具体的泛化原因包括制度所涉及的基本概念较为模糊、对诚信社会的认识不到位、过于注重制度的工具效用以及缺乏上位法支撑。失信联合惩戒泛化问题的解决应从制度设计与制度实施两方面予以规范。

The reasons for the joint punishment system for dishonesty include building a trustworthy society and making up for the deficiencies of subsequent supervision.However,the generalization of the system in legislation and practice has become increasingly prominent.The specific reasons for generalization include the vague basic concepts involved in the system,inadequate understanding of a trustworthy society,excessive emphasis on the utility of the system,and lack of support from higher-level laws.The solution to the generalization of joint punishment for dishonesty should be regulated from two aspects:system design and system implementation.
