中国大陆、中国台湾地区及FIDIC工程施工合同比较研究

A Comparative Study of Construction Contracts Between Chinese Mainland,Taiwan and FIDIC

中国大陆、中国台湾工程施工合同与及FIDIC合同条件是不同地区工程施工的重要依据文件,中国台湾地区针对公共工程采购专门制定了“工程采购契约模板”,两岸合同由于利益各方地位差异造成约束和处罚的程度存在较大差异。研究比较两岸及FIDIC合同,比较内容主要包括工程相关称谓,工程款支付,工程查验,变更及索赔,竣工验收,履约期限,工程保险,争议解决方法,研究通过分析三方合同的差异部分,为大陆公共工程采购提供部分参考。研究比较发现,由于合同规范的对象不同,中国台湾地区工程施工合同对承包商的限制较多,处罚较重,而对机关的限制和处罚较少。

The construction contract and FIDIC contract conditions of the mainland and Taiwan are important basis documents for construction in different regions.Taiwan has specially formulated the"project procurement contract template"for public project procurement.Due to the different status of interested parties,there are great differences in the degree of constraint and punishment between the two sides of the contract.The paper studies and compares the cross-strait and FIDIC contracts.The comparison mainly includes project related terms,project payment,project inspection,change and claim,completion acceptance,performance period,project insurance,dispute resolution,through the analysis of the differences of the three party contracts,to provide some reference for the mainland public project procurement.It is found that due to the different objects of contract specifications,construction contracts in Taiwan impose more restrictions and heavier penalties on contractors,while less restrictions and penalties on authorities.
