新时代检察机关法律监督路径探析

On Legal Supervision of Procuratorial Organs in New Era

充分发挥检察机关法律监督职能作用,促进社会治理,是检察机关今后一个时期重要的工作内容。但实践中却存在检察机关履行监督职责重要的监督方式——制发检察建议,柔性有余,刚性不足,甚至有的被监督对象对检察建议置之不理,检察建议的法律地位和法律效力略显尴尬。本文提出应当从拓展法律监督范围,提升法律监督能力,建立健全检察机关内部的监督体系和奖惩机制,加强人才引进和培养机制的建设,强化现代技术与法律监督相结合等措施予以解决。

It is an important task of the procuratorial organs to give full play of supervison and promote social governance.However in practice,making and issuing procuratorial suggestions is an important supervision method of procuratorial organs to perform their supervision duties,which is more flexible than rigid.Even some supervised objects ignore procuratorial suggestions,so the legal status and effect of procuratorial suggestions are slightly embarrassing.This paper proposes that we should expand the scope of legal supervision,improve the legal supervision ability,establish the internal supervision system and reward/punishment mechanism in the procuratorial organs,strengthen the human resource construction and training mechanism,combine the modern technology with legal supervision,so as to solve this dilemma.
