高校人事争议司法救济实证研究——以168份民事判决书为样本的考察

An Empirical Study on Judicial Relief of Personnel Disputes in Universities——An Investigation with 168 Civil Judgments as Samples

借助于对高校人事争议司法裁判文书样本的实证观察,可以管窥高校人事争议的实践特征,回溯高校人事争议形成的缘由,明确高校人事争议的防范路径。当前,高校人事争议呈现出地域分布广泛、数量逐年递增、教师起诉居多、诉讼案由集中和裁判结果多元等特征,究其原因,与高校资源分配的非均衡化、人才竞争的非正常化、人事制度的弱法治化、人事管理的非规范化和人事关系的类契约化不无关系。因此,应当通过优化高校资源配置、引导高校有序竞争、强化高校法治建设、规范高校人事管理与厘清高校人事关系来科学防范和有效化解高校人事争议。

Based on the empirical observation of the samples of judicial judgment documents on personnel disputes in colleges and universities,the practical characteristics of personnel disputes in colleges and universities can be seen,the causes of the formation of personnel disputes in colleges and universities can be traced back,and the prevention path of personnel disputes in colleges and universities can be clarified.At present,the personnel disputes in colleges and universities are characterized by wide geographical distribution,increasing number year by year,the majority of lawsuits filed by teachers,centralized litigation and diversified judgment results.The reasons are related to the unbalanced distribution of resources,the irregular competition for talents,the weak rule of law of personnel system,the irregular management of personnel and the contractualization of personnel relations.Therefore,we should optimize the allocation of resources in universities,guide the orderly competition in universities,strengthen the construction of the rule of law in universities,standardize the personnel management in universities and clarify the personnel relations in universities to prevent and effectively resolve the personnel disputes in universities.
