个人破产法失权制度的研究

失权制度作为个人破产制度中的重要内容,对自然人债务人起到监督与惩罚作用。但是,由于失权制度本身所具有的限制性,必须明确该制度的实质内容。具体而言,我国的失权制度应采用裁判失权主义为原则,实质内容为限制高消费、限制特定任职资格、失权公示制度。

As the significant part of individual bankruptcy system, disqualification system plays a role in supervising and penalizing individual debtor. Owing to there exists some limitation of disqualification system, its substantive contents are necessarily definite. Specifically speaking, our disqualification system should put to use judgment-disqualification model as principle, and limiting high consumption, limiting certain competence for a post and publishing disqualification contents constitute the substantive contents of it.
