The Coinage Right in the Metaverse

元宇宙作为全球资本角力的新一代沉浸式互联网,将物理世界映射到数字空间之中,将深刻改变人类社会的行为模式与存在形态。目前对于元宇宙的规制缺乏统一标准,对其空间的治理需匹配相应的治理手段与能力,以适应数据作为基础性生产要素的空间发展逻辑。数字人民币作为拥有技术优势的数字化法币,相较数字代币具有币值稳定、规模优势与以国家信用为背书的优点,以适应元宇宙下跨境跨空间支付体系建设与监管的客观需要。当前围绕技术创新的竞争已从实体领先扩大至标准制定,元宇宙空间的铸币权对扩展数字经济的广度与深度、维护国家数字经济主权与安全意义重大。在推进跨空间支付体系建设的过程中,数字人民币发行机构可能面临垄断制裁、"长臂管辖"以及法律规定难以适应空间权利义务运行方式转型等诸多困境。需要围绕数字人民币国际化、空间化应用制定长远的立法规划,确定相对统一的数字经济治理规则,促进元宇宙空间健康发展。

As the new generation of immersive Internet for which the global capital has struggled, the metaverse maps the physical world into the digital space, which profoundly changes the behavioral pattern and existence of human society. However, the unified regulatory standards of metaverse across the globe are still absent. Therefore, the corresponding governance methods and capabilities should be matched with its space governance as to adapt to the spatial development logic of data as a basic factor of production. As the legal digital currency with technological advantages, e-CNY assemble the advantages of stable value, scale advantages and endorsement of national credit compared with other digital tokens, and meet the needs of cross-border and trans-spatial payment system construction and supervision in the metaverse. The competition around technological innovation has expanded from entity leading to standards setting. It is of great significance to seize the coinage right of the metaverse to expand the breadth and depth of digital economy and maintain the sovereignty and security of national digital economy. In promoting the construction of trans-spatial payment system, the e-CNY issuing authority may face many difficulties, such as monopoly sanctions, "long-arm jurisdiction" and legal provisions that are difficult to adapt to transformation of the operation mode of space power and obligations. It is necessary to formulate a long-term legislation plan for the internationalization and spatial application of the e-CNY, determine the comparatively unified rules for the governance of the digital economy, and promote the healthy development of metaverse.
