传统习惯法影响下的瑶麓社区治理研究

Governance of Yaolu Community under Influence of Traditional Customary Law

生活在特定历史条件和特定环境下的一群人,为了自身的生存发展,会产生一系列约定俗成的惯例,这些惯例会上升为当地的习惯法,约束当地人的行为习惯,维护当地的社会稳定。习惯法是集众人商议,有着一定的民主性,瑶麓格外重视它的权威性也会自觉去遵守和维护习惯法。在国家对民族地区治理程度不断加大的过程中,传统习惯法的的地位、作用以及何去何从值得我们探讨,在今后民族地区的治理中,如何合理运用习惯法也是我们值得我们思考的问题。

A group of people living under specific historical conditions and specific environment will produce a series of established practices for their own survival and development.These practices will rise to local customary laws,restrict local people’s behavior habits and maintain local social stability.Customary law is deliberative and has a certain degree of democracy.Yaolu attaches great importance to its authority and will consciously abide by and maintain customary law.In the process of increasing the degree of national governance in ethnic areas,the status,role and direction of traditional customary law are worthy of our discussion.In the governance of ethnic areas in the future,how to make rational use of customary law is also worthy of our consideration.
