《公共图书馆法》视域下图档博融合发展的法理依据与路径探索

The Legal Basis and Path Exploration of the Integrated Development of Libraries,Museums and Archives from the Perspective of Public Library Law

图书馆、档案馆、博物馆融合发展是社会经济文化与科技发展的必然趋势。《公共图书馆法》关于图书馆、博物馆、档案馆、纪念馆等机构馆藏档案、文物资源合作利用的相关条款,对于公共图书馆领域开展图档博合作具有指导性意义。目前,业界对图档博合作的法理认识不足,学界对于图档博融合发展的路径也众说纷纭,导致图档博合作实际融合度不高,成果利用率不足。随着智慧图书馆、智慧档案馆、博物馆人工智能、数字人文等技术的长足发展,《公共图书馆法》框架下图档博馆藏档案、文物资源的融合发展路径将进一步拓宽。研究通过回顾《公共图书馆法》第三十二条的立法背景、国内外图档博合作法规的历史与现状,梳理图档博融合发展的法理依据,根据三者的职能特点,结合技术发展趋势,提出促进图档博融合发展的路径。

The integrated development of libraries,archives and museums is an inevitable trend of social,economic,cultural and technological development.The relevant provisions of the Public Library Law on the cooperative utilization of archives and cultural relics resources in libraries,museums,archives,memorials and other institutions have guiding significance for the cooperation between libraries,archives and museums in the field of public libraries.At present,the industry has insufficient understanding of the legal principles of the cooperation of libraries,archives and museums,and the academic circles have different opinions on the path of the integrated development of libraries,archives,and museums,resulting in a low degree of actual integration of the cooperation of libraries,archives,and museums,and insufficient utilization of achievements.With the rapid development of technologies such as smart libraries,smart archives,artificial intelligence in museums,and digital humanities,the integration and development path of archives and cultural relics resources in libraries,archives,and museums under the framework of the Public Library Law will be further broadened.By reviewing the legislative background of Article 32 of the Public Library Law,the history and current situation of domestic and foreign library,archives,and museum cooperation regulations,the study sorts out the legal basis for the integrated development of libraries,archives,and museums.According to the functional characteristics of libraries,archives,and museums,combined with the technological development trend,it proposes a path to promote the integrated development of them.
