摘要
本文对比了欧、美、日、韩等发达国家或地区专利与标准创新融合机制以及国际标准化组织专利政策的主要内容和特点,结合我国专利和标准政策,探讨目前我国专利与标准创新融合存在的问题和解决方案;分析专利与标准创新融合的必要性和可行性,并从专利与标准创新融合机制角度提出符合我国标准发展的建议,为我国企业提高专利技术转化水平、提高标准科技含量、提升标准竞争力等方面提供路径参考和技术支撑,促进国内产业技术革新升级和科技成果转化。
The integration mechanisms between patent to standard in developed countries such as European countries, the United States, Japan and Korea, and the main contents and features of the patent policy published by International Standard Organizations was compared in this paper. Combined with the patent and standard policies in China, the current problems and solutions in the innovatively integration between patents and standard was also discussed in this assay. Otherwise, the necessity and feasibility of the integration was analyzed in order to provide the suggestions which can be suitable for the development of standardized work in our country. The main purpose of the article was to provide path reference and technical support for Chinese enterprises who is able to improve the level of patent technology transformation, the standard technology content and standard competitiveness, etc. Ultimately, domestic industries can achieve technological upgrading and the application of advanced science and technology.
