摘要
我国现行法律框架虽然规定了抵押权预告登记制度,但并未明确其效力如何。《民法典》公布后,《最高人民法院关于适用<中华人民共和国民法典>有关担保制度的解释》虽明确了抵押权预告登记的优先受偿性,但抵押权预告登记权利人在执行程序中仍然无从寻找权利保障机制和救济途径。论文通过对抵押权预告登记在执行程序中的效力分析,认为应承认在执行程序中抵押权预告登记权利人享有一定的优先受偿权,并且可以阻却法院采取拍卖、变卖等措施处分不动产,但是无权对抗法院的查封措施。
Although the current legal framework of China provides the system of advance registration of mortgage,it does not clarify how effective it is.After the publication of the Civil Code,the Interpretation of the Supreme People's Court on the Application of the Security System of the Civil Code of the People's Republic of China has clarified the priority of mortgage advance notice registration,the right holders of mortgage registration still have no way to find the mechanism and remedy to protect their rights in enforcement procedures.This article analyzes the effectiveness of the advance notice registration of mortgage rights in enforcement procedures,accepts that the right holder of mortgage advance notice registration should enjoy a certain priority of compensation in the enforcement procedures and can prevent the court from taking measures such as auction and selling-off to dispose of the property,nevertheless,it has no right to oppose the court's seizure measures.
