An Empirical Study on Abnormal Patent Application in China

研究非正常申请专利行为所具有的特征,并且设计专利检索式进行了检索和验证,结果表明,非正常申请专利行为具有批量申请、利用费减、不提实审、文本质量差、关联补贴政策等特征,进而给出一些抑制非正常申请专利行为的建议,包括审查部门制定客观衡量指标的筛查程序、建立非正常申请行为“黑名单”、调整费用减缓政策等。

This paper studies the characteristics of abnormal patent applications, and designs a patent retrieval mode for retrieval and verification. The results show that the abnormal patent applications have the characteristics of applying for lots of patents in a short time, using cost reduction policy, staying away from the substantive examination phase, poor quality of patent documents and related subsidy policies. Therefore, some suggestions are given to restrain abnormal patent applications, including the screening procedure of the examination department to formulate objective measures,the establishment of abnormal patent applications blacklists, and the adjustment of patent funding policy.
