基层检察机关案例资源管理研究

Research on Case Resource Management of Grass-roots Procuratorial Organs

基层检察机关办案中,存在案例共享度差、缺乏编辑整理等实际问题,严重影响着案例在司法办案中的作用发挥。且理论研究方面,多集中在对案例指导制度的研究,缺乏对基层检察机关案例资源管理方面的探索。本文坚持问题导向,以基层检察机关案例资源为研究对象,从案例资源管理概述、案例资源管理的必要性、基层检察机关在案例资源管理中存在的问题及其解决路径四个方面对案例资源管理进行系统、全面分析论证,以期为基层检察机关解决案例碎片化、分散化问题提供思路。

With the increasing importance of cases and the continuous development of case guidance system,the spontaneous use of cases has gradually attracted our attention.In judicial practice,more and more prosecutors will not only refer to the guiding cases issued by the Supreme Law and the Supreme Procuratorate,but also collect more existing cases in the region and the court.However,there are practical problems such as poor sharing of cases and the lack of editing and sorting in grass-roots case handling,which seriously affect the role of cases in judicial case handling.In the aspect of theoretical research,most focus on the study of case guidance system,lacking the exploration of case resource management of grass-roots procuratorial organs.This paper adheres to the problem-oriented,takes the case resources of grass-roots procuratorial organs as the research object,and systematically and comprehensively analyses and demonstrates the case resources management from four aspects:overview of case resource management,necessity of case resource management,problems existing in case resource management of grass-roots procuratorial organs and their solutions.It is expected to provide ideas for solving the problem of case fragmentation and decentralization in the grass-roots procuratorial organs.
