摘要
受运输需求快速增长、长赐轮搁浅事件以及境外新冠疫情蔓延等因素影响,国际集装箱海运市场出现了前所未有的高运价局面,集装箱价格高达以前的几倍甚至十几倍,许多货主根本无力支撑如此高的运价,不得不放弃部分订单。在系统研究当前国际集装箱海运市场高运价形成原因的基础上,从公法和私法两个角度分别理性审视高运价的法律适用以及是否构成垄断等问题,最后提出解决方案,为规制集装箱海运市场、推动航运界立法提供参考。
Under the influence of the rapid growth in the demand for transportation,the stranding accident of EVER GREEN and the COVID-19 pandemic,unprecedented high prices have appeared in the international maritime container market,with the price soaring by several or even more than a dozen times.Being unable to afford the high price,many cargo owners have to give up some orders.Based on a systematic research of the causes for the high price of maritime container transportation in the current international market,the paper examines the law application of the high prices from both the public law and private law and tries to determine whether monopoly exists.It also puts forward solutions aiming at providing reference for the regulation of the maritime container market and development of the legislation for the shipping industry.
