互联网市场不应采取超前反垄断政策--以稳健为本位、以保守为态度

The Internet Market Should Not Adopt Advanced Antitrust Policies--Taking Prudence as the Standard and Conservatism as the Attitude

互联网的飞速发展带来了传统反垄断理论难以解决的问题,各界纷纷表示应当制定“前瞻性”反垄断政策以提前规制。但是,互联网双边性、传导性等不同于传统市场的特点可能会导致“前瞻性”反垄断政策产生无法预估的影响,甚至破坏性后果;互联网市场尚未达到必须采取“前瞻性”反垄断政策的程度。因此,当前不应在互联网市场采取超前的反垄断政策,而应以稳健为本位、以保守为态度,采取“保护性预防规制”措施,在尊重市场自身发展规律的前提下,尽可能使互联网市场呈现健康发展趋势。

The rapid development of the Internet has brought about problems that can not be solved by traditional antitrust policies,and people from all walks of life have expressed that“prospective”antitrust policies should be formulated to regulate them in advance.However,the characteristics of the Internet,such as bilateral feature and conductivity,which are diff erent from the characteristics of traditional markets,may lead to unpredictable eff ects and even destructive consequences of“prospective”antitrust policies;the Internet market has not yet been in the situation where it is necessary to adopt a“prospective”antitrust policies.Therefore,at present,the advanced antitrust policies should not be adopted in the Internet market,but it should be based on prudence and a conservative attitude,and take measures of“protective and preventive regulation”under the premise of respecting the development law of the market itself,and make it possible for the Internet market to show a healthy development trend.
