“知假买假”的全领域认可与制度规范

Recognition and System Specifi cation of the Whole Field of“Know-fake-buy-fake”

2017年最高人民法院办公厅对十二届全国人大五次会议第5990号建议的答复意见,对食药领域的“知假买假”行为给予了认可,但同时造成了我国《食品安全法》与《消费者权益保护法》在进行消费者权益保护上的不统一。实现对全领域“知假买假”行为的认可不仅能够使消费者权益保护的相关法律统一适用,并且对于社会公益的保护也有极大的积极作用。但也应当承认,目前“知假买假”所起到的效果与理想要求仍存在很大差距,因此应当通过建立消费者维权数据库、制定公众监督规章、支持公益代表等方式,保证在认可“知假买假”行为后,更好地实现公众监督对市场发展的重要作用。

In 2017,the General Offi ce of the Supreme People’s Court responded to the Suggestion No.5990 of the Fifth Session of the 12th National People’s Congress,which recognized the behavior of“know-fake-buy-fake”in the fi elds of food and drug,but at the same time caused the inconsistency between the Food Safety Law and the Consumer Rights and Interests Protection Law in the protection of consumer rights and interests.The realization of the recognition of the whole fi eld of“know-fake-buy-fake”behavior can not only make the unifi ed application of relevant laws on the protection of consumer rights and interests,but also play a greatly positive role in the protection of social public welfare.But it should also be acknowledged that the“know-fake-buy-fake”of eff ect and the ideal requirements still exist a large gap,and therefore regulations shall be formulated by establishing database of consumer rights protection,public supervision and regulation,support public welfare representatives,to guarantee after approval of“know-fake-buy-fake”behavior and to better realize the important role of public supervision in the market development.
