摘要
NFT艺术品是数字艺术与区块链技术融合的产物,凭借加密结算、流通性强的优势受到投资者的青睐。NFT艺术品市场虽然潜力巨大,但缺乏相应的监管,造成新型侵权案件频发,既损害了著作权人的合法权益,又产生了区块链经济泡沫。在此背景下,本文针对NFT艺术品著作权利益的保护,对NFT艺术品的独创性、著作权的主要内容、侵权归责原则及认定等问题进行分析,并提出NFT艺术品著作权利益保护的可行性建议,以供参考。
NFT artwork is a product of the integration of digital art and blockchain technology,and is favored by investors due to its advantages in encrypted settlement and strong liquidity.Although the NFT art market has great potential,it lacks corresponding supervision,resulting in frequent occurrence of new infringement cases,which not only damages the legitimate rights and interests of copyright owners,but also creates a blockchain economic bubble.In this context,this study analyzes the originality of NFT artworks,the main contents of copyright,the principle of attribution and identifi cation of infringement,and proposes feasible suggestions for the protection of copyright of NFT artworks for reference.
